These terms govern your use of the Digiator website and the ways you contact us through it. They set the ground rules for the site itself — they do not replace the specific agreement for any project we take on together. Where these site terms and your signed project agreement differ, the project agreement governs the work.

2. Who we are
This website is operated by Digiator, the public brand of a sole proprietorship whose registered trading name is Digiator – Website Development and Digital Marketing Agency, based in Indore, Madhya Pradesh, India (“Digiator”, “we”, “us”, “our”). We build websites and run marketing, technology and custom-software projects for our clients. You can reach us using the details in section 14.
3. What this website is for
This site exists to explain what Digiator does, show anonymised examples of our capability, and let you start a conversation with us. Everything on it — including service descriptions, case summaries, articles and guides — is provided for general information only. It is not professional, legal, financial, medical or technical advice for your specific situation, and it is not an offer capable of acceptance. Any example figures or timelines shown on the site are illustrative and are not a promise of any particular result for your business.
4. No client relationship is created automatically
Reading this website, submitting an enquiry, messaging us on WhatsApp, or taking part in a free consultation does not by itself create any client, contractual, advisory or professional relationship, and places no obligation on you or on us. A working relationship begins only when both parties agree a separate written proposal or agreement for a defined scope of work. Until that document is accepted, either side is free to walk away.
5. Enquiries, consultations and proposals
We accept enquiries 24/7 and usually respond within one hour. A free consultation is a short conversation to understand your business and where growth or operations may be blocked; it does not commit you to anything.
Any proposal we send is custom-scoped around your specific problem. Scope, deliverables, fees, timelines, change-handling and other commercial terms are set out in that proposal and in the agreement for your project — not on this website, which carries no price list. Figures and timelines in a proposal are estimates that become binding only within a signed agreement. Proposals are prepared for the named recipient, are confidential to them, and must not be shared, published or used to solicit competing bids without our written consent.
6. Projects, deliverables and ownership
When we work together, the specific agreement for your project governs everything about that work, including fees, scope, third-party costs, change requests, ongoing maintenance or care plans, and support. In particular:
- Ownership and handover. Rights in the deliverables we create for you — such as website code, designs and content produced specifically for your project — transfer to you as set out in your agreement and on full payment. Until then, they remain ours. Pre-existing tools, frameworks, know-how and any third-party components stay owned by their respective owners and are provided to you under their own licences.
- Third-party costs. Items such as domain registration, hosting, advertising spend and platform or software subscriptions are third-party services. Their fees are payable by you and are billed as described in your project agreement.
- No guaranteed outcome. Marketing, advertising and growth results depend on many factors outside our sole control — your market, offer, pricing, budget, sales follow-up and the third-party platforms involved. We commit to professional, diligent work and clear reporting; we do not guarantee any specific level of leads, sales, ranking, revenue or return.
7. Intellectual property on this website
The content and design of this website — including the DIGIATOR name and logo, text, graphics, layout, and any anonymised case material — belong to Digiator or its licensors and are protected by intellectual-property and trademark law. You may view the site and share links to it for your own personal or business evaluation. You may not copy, reproduce, republish, scrape, resell, or create derivative works from any part of it, or use our name, logo or brand, without our prior written permission. Nothing on this site grants you any right in our trademarks or content.
8. Acceptable use
When you use this site, you agree to use it lawfully and to provide accurate information in any enquiry you submit. You must not: attempt to gain unauthorised access to the site or its systems; introduce malware or disrupt or overload the site; scrape or harvest data or contact details; impersonate any person or business; submit unlawful, infringing, defamatory or misleading content; or misuse our enquiry, WhatsApp or email channels to send spam or unsolicited marketing.
9. Third-party links, platforms and tools
This site may link to external websites, and we use reputable third-party platforms to run it — for example analytics and advertising services (such as Google, Meta and Microsoft Clarity), messaging (WhatsApp) and, within client projects, a third-party payment gateway. These services operate under their own terms and privacy policies and may charge their own fees. We do not control external websites we link to and are not responsible for their content or practices. We work hard to keep this website accurate, current and available, but we provide it on an “as is” and “as available” basis. Our liability in connection with any project is governed by, and limited as set out in, the specific agreement for that project. Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including under India’s consumer-protection laws.
12. Your indemnity
You agree to indemnify Digiator against reasonable claims, losses and costs arising from your misuse of this website, your breach of these terms, or any unlawful or infringing content you submit through it.
13. Changes to these terms, and governing law
We may update these terms from time to time to reflect changes in our services, technology or the law. The current version always applies, so please check the “last updated” date above. Continuing to use the site after a change means you accept the updated terms.
These terms, and any dispute relating to this website, are governed by the laws of India. Subject to any right you have under applicable law, the courts at Indore, Madhya Pradesh will have jurisdiction. This clause does not affect the separate governing-law and dispute-resolution terms in any signed project agreement, which prevail for that project.
